PREAMBLE

These Terms and Conditions of Sale (hereinafter "Terms") govern all sales made through the website www.goldenpacers.com, operated by Golden Pacers, a sole proprietorship registered under SIREN number 823 817 630, with its registered office at 155 cours Albert Thomas, 69003 Lyon, France (hereinafter "the Seller").

These Terms apply to any purchase made by a natural person acting as a consumer (hereinafter "the Customer"). By placing an order on the website, the Customer acknowledges having read and accepted these Terms in full and without reservation.

The Seller reserves the right to amend these Terms at any time. The applicable Terms are those in force at the date the order is placed.

ARTICLE 1 — PRODUCTS

The products offered for sale are described on the website as accurately as possible (name, features, visuals, price, available sizes). However, minor variations in colour or appearance may exist between the visuals displayed on the website and the product received, without this constituting a defect of conformity. In the event of a manifest error in a product description, the Seller shall not be bound.

Products are offered subject to availability. In the event a product becomes unavailable after the order has been placed, the Customer will be notified as soon as possible and may choose between a full refund and an exchange.

ARTICLE 2 — PRICES

Prices are displayed in euros (€) and include all applicable taxes. The Seller reserves the right to modify prices at any time. The price applicable to an order is the price displayed on the website at the time of order validation.

Shipping costs, if any, are communicated to the Customer before final order validation. Free shipping may be offered based on promotional thresholds indicated at checkout.

ARTICLE 3 — ORDERS

The Customer places an order on the website by following the online ordering process. The Customer is responsible for verifying the accuracy of all information provided (identity, shipping address, email address, product selection). The Seller cannot be held liable for errors made by the Customer during data entry.

The order is only finalised upon confirmation of full payment. A confirmation email summarising the order details is sent to the email address provided by the Customer. If the Customer has entered an incorrect email address and does not receive the confirmation, the Seller declines all responsibility. The order remains valid.

The Seller reserves the right to refuse or cancel any order for legitimate reasons, including but not limited to payment authorisation failure, suspected fraud, or an ongoing dispute with the Customer.

ARTICLE 4 — PAYMENT

Payment is due at the time of order and may be made by credit or debit card, PayPal, Apple Pay, or any other secure payment method available on the website. All transactions are processed by Stripe and PayPal with SSL encryption.

The payment amount is charged upon order validation. In the event of payment failure, the order is automatically cancelled.

The products remain the property of the Seller until the price has been paid in full.

ARTICLE 5 — SHIPPING AND DELIVERY

Orders are dispatched within 2 to 7 business days from payment confirmation. All shipments are handled by Colissimo. Delivery is available in mainland France and internationally. Delivery times are provided as estimates and depend on the carrier and destination.

The transfer of risk to the Customer occurs upon handover of the parcel to the carrier. The Customer has 48 hours from receipt to report any damage, broken packaging, or missing items by contacting the Seller at hello@goldenpacers.com.

In the event of a significant delivery delay (exceeding 30 days beyond the estimated date), the Customer may request cancellation of the order and a full refund in accordance with applicable consumer protection laws.

ARTICLE 6 — RIGHT OF WITHDRAWAL

In accordance with applicable European consumer protection regulations, the Customer has a period of 14 calendar days from the date of receipt of the product to exercise the right of withdrawal, without having to provide a reason.

To exercise this right, the Customer must inform the Seller of the decision to withdraw by email at hello@goldenpacers.com or by post to the registered office address, clearly stating the intention to withdraw (order number, product concerned, date of receipt).

The Customer must return the product within 14 days of notifying the withdrawal. Returned items must be unworn, unwashed, and in their original condition, with all tags and packaging intact. Any product returned incomplete, damaged, or showing signs of use may be subject to a deduction or refusal of refund.

Return shipping costs are borne by the Customer, unless otherwise stated.

The refund is issued within a maximum of 14 days from receipt of the returned item, to the original payment method used at the time of purchase.

ARTICLE 7 — LEGAL GUARANTEES

The Seller is liable for defects of conformity and hidden defects in accordance with applicable French and European consumer protection legislation.

The Customer may, within a period of 2 years from delivery of the product, obtain repair or replacement of a non-conforming product, and failing that, a price reduction or cancellation of the sale.

In the case of hidden defects, the Customer may choose between cancellation of the sale or a reduction of the sale price.

ARTICLE 8 — LIABILITY

The Seller shall not be held liable for failure to perform the contract in cases of force majeure, disruption or strike affecting postal and transport services, flood, or fire.

The Seller's liability shall not extend to inconvenience or damage inherent to the use of the internet, including but not limited to service interruptions, external intrusion, or the presence of computer viruses.

ARTICLE 9 — PERSONAL DATA

Personal data collected during the ordering process (name, address, email, phone number) is required for order processing, shipping, and customer relationship management. The data controller is Golden Pacers, SIREN 823 817 630.

Data may be shared with trusted service providers involved in order fulfilment (payment processors, carrier). Data is never sold or shared with third parties for commercial purposes without the Customer's consent.

In accordance with the General Data Protection Regulation (GDPR) and applicable French data protection legislation, the Customer has the right to access, rectify, delete, port, and object to the processing of personal data. These rights may be exercised by email at hello@goldenpacers.com or by post to the registered office.

The Customer may subscribe to the Golden Pacers newsletter and unsubscribe at any time via the unsubscribe link included in each email.

ARTICLE 10 — INTELLECTUAL PROPERTY

All content on the website www.goldenpacers.com (text, photographs, visuals, logos, trademarks, graphic design) is the exclusive property of Golden Pacers and is protected by French and international intellectual property laws. Any reproduction, representation, modification, or exploitation, in whole or in part, without prior written authorisation from the Seller, is strictly prohibited and constitutes infringement.

ARTICLE 11 — DISPUTE RESOLUTION

In the event of a dispute that cannot be resolved amicably, the Customer may use the free mediation service offered by the Seller. The Customer may also submit a complaint on the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

ARTICLE 12 — GOVERNING LAW AND JURISDICTION

These Terms are governed by French law. In the event of a dispute and in the absence of an amicable resolution, the competent French courts shall have jurisdiction.
